Terms of Service

These Terms of Service ("Terms") govern your access to and use of the YourFitnessBrand Manufacturing website and services. By placing an order or using this site, you agree to these Terms.

1. Eligibility

You must be at least 18 years old and have the legal authority to enter into a binding contract — either personally or on behalf of a business entity — to place an order with us.

2. Custom Manufacturing Orders

• All orders are custom-manufactured to your specifications. Once production begins, orders cannot be cancelled or modified.
• A non-refundable deposit (typically 50%) is required to begin production. Final balance is due before shipment.
• Specifications, including dimensions, colors, logo placement, and quantity, are locked at the time of order confirmation.
• You are responsible for verifying all spec sheets, mockups, and approval documents before production begins.

3. Pricing & Payment

• Prices are quoted in US dollars and valid for 30 days from quote date
• Quotes include manufacturing, custom branding, freight, and US customs duties unless otherwise noted
• Payment is accepted via credit card, ACH transfer, or wire transfer
• We reserve the right to refuse or cancel any order at our discretion before production begins, with full refund of any deposit paid

4. Delivery Timeline

Standard delivery is approximately 45 days from order confirmation. Due to variables outside of our control — including customs inspections, port congestion, and freight complications — delivery may extend to 70–80 days in some cases. We commit to delivering within 80 days of order confirmation. Refer to our Shipping Policy for full details.

5. Intellectual Property

You retain all rights to logos, branding, and trademarks you provide to us. By submitting these to us, you grant us a limited license to reproduce them solely for the purpose of manufacturing your order. You represent and warrant that you have the legal right to use any logos or trademarks you submit.

All website content, including product designs, photography, copy, and original branding belongs to YourFitnessBrand Manufacturing and may not be reproduced without written permission.

6. Product Specifications & Variation

Custom manufactured equipment may have minor variations from sample images or mockups, including:

• Slight color variations due to powder coat batches and lighting
• Minor weld appearance differences (within structural tolerance)
• Logo placement variation within a 1/4" tolerance

These variations are normal for custom manufactured commercial equipment and are not considered defects.

7. Defects & Limited Credit Warranty

We do not offer return-based product warranty. All resolution of damage, defects, or quality issues is governed exclusively by our Satisfaction Guarantee and the limited credit warranty described below.

Arrival window (covered under the Satisfaction Guarantee):

• Partial refund or store credit for cosmetic defects reported within 48 hours of delivery
• Replacement parts or local repair coordination for functional defects reported within 7 days of delivery
• Full refund for total loss or unusable equipment, without return shipping requirements

Extended credit warranty (8 days to 6 months after delivery):

For proven mechanical defects originating from manufacturing — including structural weld failure, hardware failure, and moving-part malfunction — that are discovered after the initial 7-day functional defect window, we offer store credit toward future orders on the following schedule:

• 8–60 days after delivery: 25% store credit of the affected item's purchase price
• 61–120 days after delivery: 15% store credit of the affected item's purchase price
• 121–180 days after delivery: 5% store credit of the affected item's purchase price
• After 180 days: Not covered

Claim requirements: To submit a claim under the extended credit warranty, you must provide:

• Clear photos or video documenting the defect
• Your original order number
• A written description of when and how the issue occurred

What qualifies as a "proven mechanical defect": The defect must originate from manufacturing — not from use, installation, environment, or maintenance. We reserve the right to evaluate each claim and determine whether the cause is a manufacturing defect. Our determination is final.

Exclusions from the extended credit warranty:

• Normal wear and tear from commercial or residential use
• Cosmetic issues (scratches, paint chips, finish wear) — these are covered only by the 48-hour Satisfaction Guarantee window
• Damage from improper installation, misuse, modification, or third-party repair
• Environmental damage (rust from outdoor storage, humidity damage, etc.)
• Equipment used in violation of stated load capacities or use specifications
• Issues without photo or video documentation

Store credit issued under this warranty:

• Is non-transferable and tied to the original purchasing account
• Expires 12 months from the date issued if unused
• Cannot be combined with promotional discounts at time of redemption
• Cannot be exchanged for cash refund

This limited credit warranty is the sole and exclusive remedy for any claim related to product defects after the 7-day arrival window. By placing an order, you acknowledge and accept this resolution structure in lieu of any other express or implied warranty.

8. Limitation of Liability

To the maximum extent permitted by law, YourFitnessBrand Manufacturing shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, or business interruption, arising from your use of our products or services. Our total liability for any claim shall not exceed the amount you paid for the specific product giving rise to the claim.

9. Indemnification

You agree to indemnify and hold harmless YourFitnessBrand Manufacturing, its officers, employees, and partners from any claims, damages, or expenses arising from your use of our products, your breach of these Terms, or your violation of any third-party rights — including intellectual property rights related to logos or branding you supply.

10. Returns & Refunds

Because our products are custom-manufactured, we do not accept returns for buyer's remorse, change of mind, or design preference. Refunds for damaged or defective equipment are governed exclusively by our Satisfaction Guarantee and the limited credit warranty in Section 7.

11. Force Majeure

We are not liable for delays or failures in performance caused by events beyond our reasonable control, including but not limited to: natural disasters, port strikes, shipping container shortages, customs delays, war, pandemic, government action, or supplier failure.

12. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of our services shall be resolved in the state or federal courts located in Brazoria County, Texas.

13. Changes to Terms

We may update these Terms from time to time. Continued use of our services after changes constitutes acceptance of the revised Terms. The "Last updated" date above reflects the most recent revision.
